eBay's User Agreement for Trading Assistants


You must read, agree with and accept all of the terms and conditions contained in these Rules before you may become a member of the eBay Trading Assistant directory.

  1. To become a member of the eBay Trading Assistant directory, an eBay member must have a feedback rating of 50 or higher and have sold at least 4 items on eBay within the last 30 days.
  2. Trading Assistants must always uphold the eBay values, be upstanding members of the community and maintain a positive feedback rating of 90% or higher.
  3. Trading Assistants are responsible for complying with all of the terms and conditions of the eBay User Agreement and Privacy Policy at all times.
  4. Access to the Trading Assistant directory is a privilege and not a right and eBay may remove a Trading Assistant from the directory at any time. eBay retains sole discretion regarding the manner in which Trading Assistant information is listed within the directory. eBay's listing of a member in the directory does not constitute an endorsement or approval of the Trading Assistant.
  5. eBay members who have registered for listing on the Trading Assistant directory may withdraw from the directory at any time.
  6. These Trading Assistant rules relate only to the Trading Assistant directory on ebay.com. Trading Assistants are responsible for learning the different rules for engaging in activities as a Trading Assistant on any of the other international eBay web sites, and agree to comply with those rules before doing so.
  7. Trading Assistants are not representatives, employees, independent contractors or agents of eBay.
  8. eBay does not formally screen Trading Assistants to confirm a set of professional credentials.
  9. eBay is not responsible for the acts or omissions of Trading Assistants, and eBay has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings or the ability of sellers to sell items.
  10. All transactions and disputes between Trading Assistants and their clients are governed by the terms of the agreement between the Trading Assistant and the third party and not the eBay user agreement. eBay encourages Trading Assistants to enter into written contracts with clients that address all issues relevant to the relationship.
  11. Trading Assistants are responsible for the content and fees related to all listings that they facilitate, whether listed under their own User ID or in the name of a client.
  12. Trading Assistants are independently responsible for complying with all applicable domestic and international laws, statutes, ordinances and regulations regarding use of eBay and any bidding on, listing, purchase, solicitation of offers to purchase, and sale of items.
  13. Trading Assistants are responsible for evaluating all local laws relating to proxy selling on eBay for others and all laws applicable to the sale of real estate, automobiles, or other regulated items. Whenever required by law, Trading Assistants will first become licensed as a broker or dealer, assume obligations to inspect or make disclosures about the condition of the items, and comply with other legal requirements when selling these types of items for clients. In addition, Trading Assistants must also comply with the following eBay specific guidelines:
    1. eBay Cars And Bikes - Trading Assistants who are not licensed as a motor vehicle sales dealer who provide services related to the sale of a vehicle:
      1. Must not list vehicles for sale under their own User ID (unless the sale is of a personal vehicle);
      2. Must not charge a fee for services based upon a percentage of sales price; and
      3. Must not interact with bidders or filter or otherwise control the flow of information between bidders and the owner of the vehicle.
    2. Charity Listings - Trading Assistants must not reference the name of a charitable organisation in a listing as a beneficiary of the proceeds of the listing unless the Trading Assistant has obtained the advance written consent of the charity.

Trading Assistants can sell items on eBay for others. Trading Assistants operate independently as eBay sellers, and are not employees, agents or partners of eBay.
