TERMS & CONDITIONS:

• 5 Tata Sky digicomps will be listed for sale on www.ebay.in in auction-style format.
• The listing will be hosted by MPFA Artists Private Limited (an Association of Mouth and Foot Painting Artists), the authorized distributor of Tata Sky Limited.
• The listing opens on 0000 hours of 12th March 2007 & closes on 2359.59 hours 11th April 2007.
• The suggested bid price for the Tata Sky digicomp™ is Rs. 2999 for each listing.
• Each listing will have one winner. There will be a total of 5 listings - one for each Digicomp. The winner will be chosen as per the existing and standard terms & conditions of www.ebay.in.
• eBay will confirm the name of the winner per listing to Tata Sky & MFPA
• Tata Sky will deliver the digicomp™ to the winners on behalf of MFPA.
• The winners will also get 3 months free subscription of Tata Sky services.
• Each of the 5 listing winners will also receive a Complementary pass from Tata Sky for the World Cup final event to be hosted in Mumbai on 28th April 2007 by Tata Sky. These complementary passes are at the discretion of Tata Sky. In order to deliver the Complementary pass, and make necessary travel arrangements, Tata Sky will contact all winners via phone. At the time of intimation, it is necessary for the winner to furnish the following details, copy of email confirmation of eBay, full name, e-mail id, mobile no., residence phone no. and complete residential address in order to get his complementary pass.
• Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate by the company.
• The complementary pass entitles 2 persons to attend the event - each winner can bring along with him/her only ONE more person irrespective of whether the other person is an adult or a minor.
• The Complementary pass cannot be exchanged for cash, discount or any other offer.
• .In case the winner does not wish to attend the event on 28th April, 2007 he/she can nominate another person to attend on his/her behalf. However, confirmation for the same has to be sent through fax, e-mail or post to our customer care centre in Bangalore or to the contest centre in Mumbai, whichever is indicated to the winner at the time of the intimation call. Once the names of the persons attending are confirmed, they cannot be changed.
• The winner should confirm participation and furnish details of both persons attending the event, along with tentative travel plans within 24 hours of the call from Tata Sky informing him/her of the selection. Complete and correct details should be e-mailed or faxed within this stipulated time. In case the winner fails to do so within the stipulated time, he/she will be disqualified.
• The persons attending the event will have to arrange their own travel to Mumbai and should ensure that they arrive latest by 4 pm on 28th April, 2007. For arrivals post 4 pm, Tata Sky will not be able to guarantee the prize. Tata Sky will not be held liable for any expenses related to postponement, preponement, cancellation etc. or any other change in the travel itinerary of the persons attending the event.
• Tata Sky will reimburse the travel cost for a maximum two people per winning entry. Reimbursements will be made only between 12 pm on 28th April and 12 pm on 29th, April 2007. Post this period, Tata Sky will not be liable to reimburse any claims.
  
  

  1	Non-residents of Mumbai For persons who are not residents of Mumbai, the travel reimbursement will be made on presentation of the appropriate travel documents (air ticket, train ticket, bus ticket) up to a maximum of economy airfare for the shortest distance from each person's home town to Mumbai or Rs. 15,000 per person (inclusive of all taxes), whichever is less. Reimbursement will only be given if the winner/ persons attending the event, travel to Mumbai and attend the event as per Tata Sky's itinerary for 28th April, 2007 and 29th April, 2007
  2	Residents of Mumbai Persons who are residents of Mumbai will be reimbursed Rs. 1000 (inclusive of all taxes) per head as the to-and-fro taxi fare from their home address to the accommodation provided by Tata Sky. Reimbursement will only be given if the winner/ persons attending the event from Mumbai stay at the accommodation organized and provided to them by Tata Sky and follow the itinerary as set by Tata Sky on 28th April, 2007 and 29th April, 2007

• Tata Sky will provide the following to persons attending (who have confirmed their travel details within the stipulated time) the event in Mumbai (valid from 12 pm on 28th April, 2007 up to check-out at 12 pm on 29th April, 2007 only):
  • A room on twin sharing basis for one day at a hotel of Tata Sky's choice. Check-in at 12 pm on 28th April, 2007 and check-out at 12 pm on 29th April 2007.
  • Buffet lunch on 28th April, 2007 and buffet breakfast on 29th April, 2007 at the hotel of stay.
  • Transport to the event venue and back, from the hotel of stay.
  • Dinner on 28th April, 2007 at the event venue.
  • Any other food and beverage expense or personal expense borne at the hotel such as minibar use, tobacco, laundry, local calls, STD and ISD calls etc. will have to be borne by the persons attending the event. No reimbursement of any other intra-city transport or food bills will be allowed.
• Tata Sky will have the right to use the image of the listing winners in any promotional material for the event. By entering the promotion, the winner has agreed to participate in any promotional activity(ies) and/or have his/her name and likeness featured in any promotional material as Tata Sky may require.
• Tata Sky will be responsible for the TDS (Tax Deducted at Source) applicable on the prize, if any. The winner will be responsible for any other tax implications arising from the receipt of the prize. Disputes, if any, will be subject to the jurisdiction of the courts in Mumbai.
• Tata Sky has the right to change any of the terms and conditions at its discretion.
• Tata Sky will not be liable for any loss, damage or cancellation of this event caused by events beyond its reasonable control including war, natural calamities, floods etc.
• By participating in the promotion, winning the Digicomp™ and accepting the complementary pass, winners waive any right to claim ambiguity in the rules, and release, indemnify and hold harmless eBay International AG and its affiliates, Tata Sky, their respective affiliates, subsidiaries, advertising and promotion agencies, and all of their respective agents, representatives, officers, directors, shareholders and employees (collectively, "releases" from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the auction or attending the event (including but not limited to any use, misuse, or nonuse of the prize by the winner), or acceptance, possession, use, misuse or nonuse of the prize that may be awarded. Winners agree to accept the Complementary pass "as is".
• Participating winners acknowledge and agree that all disputes in relation to the listing, winning including but not limited to, eligibility, cheating, advancement and other issues related to the auction shall be determined in the sole and absolute discretion of www.ebay.in and that such a decision by by www.ebay.in shall be final and binding.
• Tata Sky subscribers participating in the promotion and listing constitute their consent (a) to comply with the rules of www.ebay.in for standard listings and to these Rules regarding the complementary pass they will recive in addition to the Digicomp, and (b) that they release and hold harmless Tata Sky, its respective subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents from any and all liability, loss or damage of any kind. Tata Sky is not responsible for printing or typographical errors in any promotion related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this contest, or process any transaction thereon. The contest is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
• The listings and promotions are brought and sponsored by Tata Sky and www.ebay.in shall not be liable for any issues / warranties (including implied warranties) relating to the digicomps, the complimentary passes and the entire promotional event (including your travel and stay). All the issues and warranties are the responsibility of Tata Sky. www.ebay.in is neither responsible nor guarantees the quality of the digicomps, complimentary passes and the entire promotional event, nor www.ebay.in is liable for any defects or deficiency or shortcomings or any risk associated with the digicomps, complimentary passes and the entire promotional event and your travel arrangements and your stay and movements in and outside Mumbai.
• www.ebay.in does not warrant that the site www.ebay.in and/or the Categories' home pages will run concurrently and error free during or after the promotion and does not commit any uptime of the site and/or the Categories' home pages.
