When is it? Starting Thursday September 01, 2005 between 00:00:01 IST (12:00 AM plus one second on September 1, 2005) and ending 23:59:59 IST on Friday, September 30, 2005 (11:59 PM plus 59 seconds). What is excluded? • Shop format listings are excluded. • Listings created during the promotion and going live after the promotion period are excluded. • Listings revised during the promotion are excluded. IMPORTANT: Sellers who qualify under the promotion will be credited with the cash back amount by end of October’05. The memo will read "Use & Win September'05 promotion credit". Terms and Conditions Terms & Conditions - Use & Win This Promotion is subject to the following terms and conditions and by entering the promotion all entrants will be deemed to have accepted and agreed to be bound by these terms and conditions: 1. The Promotion is open to all Users who are registered as Users on eBay.in and whose country of residence is India, except any employees (and their families) of eBay India Pvt. For eg: If a User has spent Rs. 5000/- (Rupees Five Thousand Only) on features in the month of August'05 and if the spend in September'05 is Rs.7500 (Rupees Seven Thousand Five Hundred Only) (50% higher) then seller gets a credit of Rs.2250 (Rupees Two Thousand Two Hundred and Fifty Only) (90% of the incremental amount). 4. The user spends on feature for August'2005 would be basis the actual spend of the user in August'05 and not include the spends that would have reflected on Users account due to certain promotions run on the site where features were given FREE. A list of all such promotions that were run in August'05 is as below Promo 1 - Take Feature Plus and 10 Day listings AND get Gallery Feature FREE. The charges reflecting on account of FREE Gallery Feature would not be included as part of User spends for August'05 Promo 2 - Subscribe to Paisa Pay and do 5 Listings with Paisa Pay AND get Gallery Feature FREE on 2 listings. The charges reflecting on account of FREE Gallery Feature would not be included as part of User spends for August'05 Promo 3 - On 3 Feature Plus listings get fee waiver on 1 feature plus listing and on 6+ feature plus listing get fee waiver on 2 feature plus listing. The charges reflecting on account of FREE Feature Plus listing would not be included as part of User spends for August'05 5. In the event of the address of the user being a non verifiable one, eBay reserves the right to cancel the entry of the user, and to select an alternative winner. 9. If eBay is not able to contact the lucky draw winner by midnight seven days after eBay's first attempted notification, eBay reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse. 10. Depending on the prize won, the winners would receive the prizes (which will be free of charge). We aim to have all prizes delivered within 45 days from the end of the Promotion, but for certain prizes this is subject to variation by the suppliers. In the event of the possibility of prizes not being deliverable to winners the winners would need to collect the same from the office of eBay. 11. No cash alternatives will be substituted for prizes. 12. The prizes is non-encashable. Any government levies/taxes like Sales Tax, TDS, Road Tax, Airport Tax, any Local Tax etc. arising out of the same will be borne by the winner and the prize will be delivered to the winner only after the winner pays the applicable taxes. 13. eBay reserves the right to add additional terms and conditions as part of the promotion. 14. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the Promotion, eBay reserves the right to suspend, change or cancel the Promotion at any time. 16. eBay reserve the right at anytime, without previous notice, to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this scheme by another scheme, whether similar to this scheme or not, or to withdraw it altogether. 17. eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Promotion. 18. eBay is the organiser of the Promotion. eBay may carry out this Promotion through its agents and partners. eBay may use third parties to facilitate one or more elements of this Promotion 19. The lucky draw prizes are subject to availability of products and services at the time of giving away the prize.
