	Terms and Conditions Terms and Conditions for the "New Lister Sweepstake" These "Terms and Conditions" are being entered into between eBay International AG (including its affiliates, holding & subsidiary companies) (individually and collectively be known as "eBay") and all registered users ("You") at www.ebay.in ("Site") who enter the "New Lister Sweepstake" ("Contest"). By clicking on / checking on "I Accept" button / option You unconditionally agree to be bound by these Terms and Conditions. Contest Batches and Contest Period Contest will start on 22nd day of August, 2006 (00:00:01 hours IST) and shall end on 10th day of September 2006 (23:59:59 hours IST). (Hereby collectively called as "Contest Period"). Eligibility Criterion for participation in the Contest and getting/being rewarded: 1) User needs to successfully list their first item for sale during the contest period on www.ebay.in. This Contest is not open for existing sellers / listers who had already listed any item for sale on www.ebay.in. 2) The user will then need to enter the Item Id on the contest page 3) Along with entering the item id on the contest page, the user would be needed to accept the Terms and Conditions of the contest. 4) The user should not be in violation of the User Agreement, Trust & Safety rules and any other applicable policies on the Site. 5) The user’s account at the Site should not have "suspended" or "on hold" status. Winning Criterion & Reward: 1) Winning Criterion: a) The user needs to list one item successfully for the first time on eBay.in b) This is a game of skill and winners will be chosen based on the use of eBay’s features, quality of information and photographs and design of listing. c) Registered users entering a valid item Id of their first listing on eBay shall be eligible to win a gift hamper from eBay. 2) There shall be 5 Grand prize winners and 5 runners up. The Grand Prize would be a Sony Cybershot Digital Camera (Model: DSC W50) each and Runner up price would be a Nokia 6030 mobile phone each. 3) The lucky winner will be selected by an independent third party. The judges' will choose winners and no correspondence will be entertained regarding the final decision, which shall be at the sole discretion of the third party agency. 4) The winners will be declared within 90 days from the date of contest end. 5) The winners will be intimated by email or the telephone number at the email address / telephone number provided at the time of registration on the Site. The user IDs of the winners would also be announced on the eBay.in discussion board on the respective dates of declaration of result. If eBay is not able to contact the winner by midnight seven days after eBay's first attempted notification, eBay reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse. 6) eBay or the administrator of this Contest would undertake reasonable efforts to deliver the prize (which will be free of any shipment charges) within 45 days from the date of declaration of results, but this is subject to variation by the suppliers of the prize. eBay or the administrator shall not be liable or held accountable for any delay in delivery of the prize. 7) eBay or the administrator shall not obtain any shipment / delivery related insurance for delivery of the prizes. The winner shall assume the risk of damage, destruction or loss of prizes during transit. 8) All product and service related issues/warranties are the responsibility of the manufacturer of the prize item. eBay is neither responsible nor guarantees the quality of the prize items, nor it is liable for any defect or deficiency or shortcoming or any risk associated with the prize items. Miscellaneous: 1. eBay reserves the right at anytime, without previous notice, to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this Contest by another Contest, whether similar to this Contest or not, or to withdraw it altogether. You hereby agree to be bound by such revised Terms and Conditions. 2. All decisions by eBay regarding the selection of winners shall be final and binding. No correspondence or appeals will be entertained in this regard. 3. Any and all taxes, including without limitation income tax and/or service tax, if any applicable on this Contest and the rewards thereto shall be borne by You and You shall deposit the applicable amount of taxes to eBay before You could avail any rewards, unless otherwise mandated under the applicable laws. 8. Any disputes arising out of this Contest shall be subject to the exclusive jurisdiction of competent courts in Mumbai irrespective of whether courts in other areas have concurrent or similar Jurisdiction. Any Indian resident who has never successfully listed on eBay before is eligible to enter. To be eligible to win a prize, you must successfully list your first eBay item on www.ebay.in between 00:00:01 second on Tuesday 22nd August 2006 and 23:59:59 pm on Sunday 10th September, 2006.

All eligible winners who have chosen the terms and conditions and eBay's policies will be chosen based on the quality of their listing.
