Eligibility Criteria:

• The promotion " "eBay NotOut Contest" " (here in after referred as "Promotion") is valid only for successful PaisaPay transaction on www.ebay.in (herein after "the Website") during Promotion Period.
• The Promotion Period means: From 24th March 2010 00:00:00 Hrs IST till 11th April 2010 23:59:59 Hrs IST.
• The offer is valid only for registered buyers of the Website with Registered Addresses in India only (herein after "the Website User").
• Buyer should pay through PaisaPay ONLY and shall use any coupon code from NOTOUT0001 to NOTOUT0099.(NOTOUT0001, NOTOUT0002 ... NOTOUT0099). Buyer should use a different coupon code for every new transaction that buyer makes. https://www.ebay.in/notout " (here in after "Micro Site").
• The gift needs to be redeemed within one month of the promotion ending.

Process to calculate Run:

• Any buyer during the Promotion Period, buys an item worth Rs.100 (including shipping) on the Website scores 1 run.

• Rs.100 (Rupees Hundred) spent on the Website = 1 Run.

• Buyer should pay through PaisaPay ONLY and shall use any coupon code from NOTOUT0001 to NOTOUT0099.(NOTOUT0001, NOTOUT0002 ... NOTOUT0099). Buyer should use a different coupon code for every new transaction that buyer makes.

Process for redemption of Gift:

• The Promotion Gift(s) cannot be redeemed immediately.
• The Promotion Gift(s) shall only be redeemed post the end of the Promotion Period.

  To redeem Promotion Gift(s), the Website User should log into the Micro Site and choose the gift as per User eligibility.

General Terms and Conditions

1. You/ Your (means the person using this Promotion with the intent to receive gift under this Promotion or the User) should not be in violation and agree to abide with the terms and conditions of the User Agreement, PaisaPay Policy and other policies of the Website (including this Promotion).
2. eBay reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the Terms & Conditions of this Promotion, or to replace, wholly or in part, this Promotion by another Promotion, whether similar to this Promotion or not, or to withdraw it altogether, and eBay's decision in this regard shall be final.
3. All decisions of eBay regarding running / process / results, of the Promotion be final and binding on You. No appeals will be entertained in this regard.
4. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, substitute, change or cancel the Promotion, eBay reserves the right to suspend, change, substitute or cancel the Promotion at any time.
5. If eBay has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity related to this Promotion or You have violated the Website User Agreement and any other Agreements or policies and processes of the Website, eBay reserves the right to disqualify that entrant and any related entrants. Any entrant user of the Website who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant user and its related user id's on the Website.
6. eBay does not warrant that the Website will run concurrently and error free during or after the Promotion Period and does not commit any uptime of the Website. Further eBay shall not be liable for issues related to technical, human error whatsoever e.g. wrong Promotion number being entered by You or You being logged out of system without completing transaction.
7. eBay does not accept, and is not responsible for, any lost or delayed data, communication. eBay reminds You of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay that may affect entry/participation to the Promotion.
8. The items are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and You, as also complying with applicable law of the land.
9. eBay is neither responsible nor guarantees the make, quality of the product, items, which is purely responsibility, liability of third party. Nor is eBay liable for any defect, deficiency, shortcoming or any risk associated with the quality, commitment, deliver timeline of the products, items.
10. Please Note: The gift(s) will be sent to Your REGISTERED ADDRESS ONLY and not the SHIPPING ADDRESS. Users are requested to update their REGISTRATION ADDRESS to ensure that they receive their gift(s).
11. Any time before dispatch of the Gift, if Your Website user ID or PaisaPay access gets suspended from the Website You will not be eligible to receive the gift under this Promotion.
12. eBay will make every attempt to dispatch the gift, however in case of a stock out situation in the market, eBay will provide a similar gift of the same or higher value.
13. The administrator of this Promotion would undertake reasonable efforts to complete the process of declaration of results, verify and dispatch the item at the earliest, by 45 days from end date of Promotion. However, is subject to no delays being caused by third party vendors or Force Majeure. eBay however shall not assume the risk of insurance and other related security, features, liability during transit.
14. For certain states within India , FORM 50/ FORM 31 are required by the courier company for the dispatch of the free gifts. When required, the registered buyer is responsible for providing the courier company with the above mentioned FORM/s to receive the free gift.
15. You understand and agree that these are gratuitous gifts, participation in the Promotion is good and sufficient consideration for You to agree and be bound by these Terms and Conditions. In case any violation of Promotion Terms and Conditions and the Website User Agreements and other Website Agreements and policies and processes, You will not be eligible to receive gift.
16. Any and all taxes, including without any limitation income tax (if any) applicable on this Promotion and the rewards / benefits thereto shall be borne by You and You shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
17. All Coupon Code "2010NOTOUT" should be redeemed within its Promotion Period.
18. All communications with You will be, on Your email (ID registered on Website) and / or community board.
19. The benefits under the Promotion CANNOT be clubbed with other offers running on the Website, including vouchers.
20. The employees and the immediate family members of the employees of eBay and its associate companies are NOT eligible to participate in the Promotion
21. You can select multiple gifts with the runs you have collected. However each gifts can be selected only once.
