Definitions
For the purposes of these terms and conditions:
a. "Program" shall mean the ICICI Bank Credit Card and eBay AG "Save and Shop Up to 50% off Promotion" to be run from 5th December, 2005 to 31st January, 2006.
b. "Card" shall mean ICICI Bank Credit Card, which has been issued by ICICI Bank and is valid and subsisting during the Program period.
c. "Card Members" shall mean such persons who have been issued the Card by ICICI Bank.
d. "Program Period" shall mean period commencing on 5th December, 2005 IST to 31st January, 2006 IST (both days inclusive).
e. "Primary Terms and Conditions" shall mean the terms and conditions applicable to the Card.

Program

1. The Contest is open to all Users who are registered as Users on eBay.in and whose country of residence is India, except any employees (and their families) of eBay India Pvt. Ltd, any affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be involved with the Contest. eBay reserves the right to verify the eligibility of entrants.
2. The Program is valid for Card Members only and shall be ongoing during the Program Period, unless otherwise notified by ICICI Bank Credit Card and eBay AG
3. To be eligible to participate under the Program during the Program Period, the Card Member shall have to make purchases on www.ebay.in using their respective ICICI Bank Credit Card.
4. This Program is applicable for the Primary Card Members only. Purchases made by add-on Card members will be added to the Primary Card Members' purchases for the purposes of this Program. The cash back will be credited to the primary Card members' account.
5. Any Card Member who shops on www.ebay.in worth Rs 500 using their ICICI Bank Credit Card, is eligible for a maximum cash-back of Rs 250/-
6. This is one time cash back offer on a valid transaction worth Rs. 500/- and more, between the period 5th December, 2005 to 31st January, 2006.
7. Maximum cash back provided under the program is Rs. 250/-
8. A maximum of one transaction worth Rs. 500/- or more per ICICI Credit Card will be eligible for the Cash Back
9. Offer is valid only on purchases where Seller has provided PaisaPay payment facility as an option;
10. Process for cash-back
    1. The Cash-back for the promotion period would be credited at the backend in the customer’s account, at the end of the promotion by ICICI Bank Credit Cards.
    2. The same would also reflect as credit entries in the customer’s credit card billing statement.
    3. The Cash-back would be paid to ICICI Bank Credit Cards customers on the actual Cash-back amount credited.
    

Other Terms and Conditions

• The participation in this Program is entirely voluntary and it is understood, that the participation by the Card Member shall be deemed to have been made on a voluntary basis. The participation in the Program shall be deemed to be acceptance of all the terms and conditions governing the Program.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• All communication should be addressed to "ICICI Bank Ltd., ICICI Bank Phone Banking Group, P.O.Box No. 20, Banjara Hills, P.O. Hydrabad - 500034 ".
• In all matters relating to the Program, the decision of ICICI Bank Credit Cards shall be final and binding in all respects.
• The terms and conditions shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Card.
• Corporate Cards (i.e. Cards with Corporate liability), Purchase Cards, Fleet Cards and Instruction Cards issued by ICICI Bank shall not be eligible for participation under the Program.
• ICICI Bank Credit Cards and eBay AG hold out no warranty or makes no representation about quality, delivery or otherwise of the goods and services offered by the aforesaid merchant establishments. Any dispute or claim regarding the goods and services must be resolved by the Card Member with the merchant establishment directly without any reference to ICICI Bank.
• ICICI Bank and eBay AG will not be liable in any manner whatsoever for any loss/ damage/ claim that arise out of use or otherwise of any goods/ services availed of by the Card Member under the Program.
• If the Card Member ceases to be a Card Member at any time during the currency of the Program, all the cash back benefits under the Program shall lapse and the same shall not be available to the Card Member.
• Card members whose account has been classified as Delinquent before or during the currency of the Program, or when the cash back is credited, will not be eligible for the benefits of the Program.
• In case of a cancelled transaction, the applicable cash back amount on that transaction would be debited.
• ICICI Bank and eBay AG reserves the right to modify/ change all or any of the terms applicable to the Program without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Program without assigning any reasons or without any prior intimation whatsoever.
• All taxes, duties, levies of whatsoever nature in connection with the Program shall be borne solely by the Card Member.
