Terms and Conditions

Eligibility:

• The promotion "eBay's 4th Anniversary Promotion" is valid for any successful PaisaPay purchase, in any category during promotion period.
• The promotion period shall be from March 25th 2009 till April 7th 2009.
• Promotion shall be valid for www.eBay.in buyers (herein after referred to as "you"), either, during the promotion period or till stocks last (which ever is earlier).
• The offer is valid only for registered buyers of www.eBay.in with shipping addresses in India only.
• Any buyer who, during the promotion period, in a single transaction, using the respective Promotion codes spends:

  a. Between Rs. 1,000/- to Rs. 4,999/-. Shall be eligible to choose a single Gift from the options, available and specified in the promotion. (herein after referred to as Category A); or,

  b. Between Rs. 5,000/- to Rs. 9,999/-. Shall be eligible to choose a single Gift from the options, available and specified in the promotion. (herein after referred to as Category B); or,

  c. Above Rs 10,000/-. Shall be eligible to choose a single Gift from the options available and specified in the promotion. (herein after referred to as Category C).

Process:

• Buyer who fulfills eligibility, to claim his Gift, will need to:

• The highest amount factually paid in the single transaction (including shipping costs) against which Gift is claimed, shall be considered as the amount of transaction.
• Only one gift can be claimed, per transaction, against each Category (A, B or C).
• Please Note: The gifts will be sent to the REGISTERED ADDRESS ONLY and not the SHIPPING ADDRESS. Users are requested to update their REGISTRATION ADDRESS to ensure that they receive their gifts.

General Terms and Conditions

1. You should not be in violation and agree to abide with the terms and conditions of the User Agreement, policies of the Site (including this promotion).
2. eBay reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the terms & conditions of this Promotion, or to replace, wholly or in part, this Promotion by another Promotion, whether similar to this Promotion or not, or to withdraw it altogether, and eBay's decision in this regard shall be final.
3. All decisions of eBay regarding running / process / results, of the promotion, data selection shall be final and binding on all participants of this promotion, including you. No appeals will be entertained in this regard.
4. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, substitute, change or cancel the Promotion, eBay reserves the right to suspend, change, substitute or cancel the Promotion at any time.
5. If eBay has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
6. eBay does not warrant that the Site will run concurrently and error free during or after the Promotion Period and does not commit any uptime of the Site. Further eBay shall not be liable for issues related to technical, human error whatsoever e.g. wrong Promotion number being entered by you or you being logged out of system.
7. eBay does not accept, and is not responsible for, any lost or delayed data, communication. eBay reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay, that may affect entry/participation to the Promotion.
8. The items are listed by third parties, who is responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land.
9. eBay is neither responsible nor guarantees the make, quality of the product, items, which is purely responsibility, liability of third party. Nor is eBay liable for any defect, deficiency, shortcoming or any risk associated with the quality, commitment, deliver timeline of the products, items.
10. The administrator of this Promotion would undertake reasonable efforts to complete the process of declaration of results, verify and deliver the item at the earliest, by 45 days. However, is subject to no delays being caused by third party vendors or Force Majuera. eBay however shall not assume the risk of insurance and other related security, features, liability during transit.
11. The gifts will be sent to the REGISTERED ADDRESS ONLY and not the SHIPPING ADDRESS. Users are requested to update their REGISTRATION ADDRESS to ensure that they receive their gifts.
12. You understand and agree that participation in the Promotion is good and sufficient consideration for you to agree and be bound by these Terms and Conditions.
13. Any and all taxes, including without any limitation income tax (if any) applicable on this Promotion and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
14. All Coupons should be redeemed within its validity period.
15. All communications with you will be, on your mail (ID registered on Site) and / or community board.
16. The benefits under the Promotion CANNOT be clubbed with other offers running on the eBay Website, including vouchers or any other offer available onsite
17. The employees and the immediate family members of the employees of eBay and its associate companies are NOT eligible to participate in the Promotion
