Terms & Conditions

 
  1. You/Your (means the person using/participating in this Promotion/Campaign with the intent to receive gift under this Promotion, or the User) should not be in violation, and agree to abide by the terms and conditions of the User Agreement, PaisaPay Agreement and other eBay Rules and Policies (“eBay UA & Policies”) of www.ebay.in (“eBay Website”) in addition to the terms and conditions of this Promotion.
  2. eBay at all times reserves its rights to amend/add/remove/modify (in whole or part), at any time, any or all the Terms & Conditions of this Promotion/Campaign, or to replace, wholly or in part, this Promotion/Campaign by another Promotion/Campaign, whether similar to this Promotion/ Campaign or not, or to withdraw it altogether, and eBay's decision in this regard shall be final.
  3. All decisions of eBay regarding running /process/results of the Promotion/Campaign shall be final and binding on You.  No appeals shall be entertained in this regard.
  4. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, substitute, change or cancel the Promotion/Campaign, eBay reserves the right to suspend, change, substitute or cancel the Promotion/Campaign at any time.
  5. If eBay has suspicion or knowledge, that any entrant/user has been involved in any fraudulent or illegal activity related to this Promotion or You have violated the eBay UA & Policies and processes of eBay Website, eBay reserves the right to disqualify that entrant/user and any related entrants.  Any entrant/user of eBay Website who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.  eBay reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant user and its related user id's on eBay Website.
  6. eBay does not warrant that eBay Website will run concurrently and error free during or after the Promotion Period and does not commit any uptime of eBay Website.  Further, eBay shall not be liable for issues related to technical, human error whatsoever, eg. wrong Promotion number being entered by You or You being logged out of system without completing transaction.
  7. eBay does not accept, and is not responsible for, any lost or delayed data, communication. eBay reminds You of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay that may affect entry/participation to the Promotion.
  8. The items/products/services are listed by third parties who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and You, as also complying with applicable law of the land.
  9. eBay is neither responsible nor guarantees the make, quality of the product, items, which is purely responsibility, liability of third party.  Nor is eBay liable for any defect, deficiency, shortcoming or any risk associated with the quality, commitment, deliver timeline of the products/items/services.
  10. Please Note that if Your eBay Website user ID or PaisaPay access gets suspended from eBay Website. You will not be eligible to receive the gift under this Promotion.
  11. eBay or Sponsor of the Promotion, as the case may be, will make every attempt to dispatch/email the gift or e-coupon code, however in case of a stock out situation in the market, eBay at its sole discretion will provide a similar gift or e-coupon code of the same or higher value.
  12. The administrator of this Promotion would undertake reasonable efforts to complete the process of declaration of results (unless context otherwise require), verify and dispatch the gift/e-coupon code by within the stipulated period mentioned in the terms and conditions of the promotion.  However, this is subject to no delays being caused by third party vendors or Force Majeure. eBay however shall not assume the risk of insurance and other related security, features, liability during transit.
  13. For certain States within India, the prescribed forms/applications/permissions are required by the courier company/logistic service providers for dispatch of the free gifts. Upon the request by the courier company/logistic service providers, the registered buyer/winner is responsible for providing the courier company with the requisite form(s)/documents to receive the free gift. In no manner eBay India or Sponsor of the Promotion, as the case may be, shall be responsible to submit the such form(s)/documents to courier company.
  14. In case any violation of Promotion Terms and Conditions and eBay Website UAs & Policies and other processes, You will not be eligible to receive gift or e-coupon code.  If You violate any of the offer terms, the offer will be invalid.
  15. Any and all taxes, including without any limitation income tax (if any) applicable on this Promotion and the rewards/benefits thereto shall be borne by You and You shall deposit the applicable amount of taxes (if any) to eBay/contract administrator/applicable governmental authorities before You/user could avail any benefits, unless otherwise mandated under the applicable laws.
  16. All communications with You will be, on Your email ID and/or mobile number registered with eBay Website and/or community board.
  17. The gifts/e-coupon code offered under the Promotion shall not be transferable.  Cash alternative for the gifts/e-coupon code stated above may be given at the sole discretion of eBay. Mere participation in the Promotion shall not entitle a participant to a gift/e-coupon code.  No other person or agent can claim the gift/e-coupon code on behalf of the Winner.
  18. The employees and the immediate family members of the employees of eBay and its associate companies are NOT eligible to participate in the Promotion.
  19. This Promotion is in no way affiliated with or sponsored by Facebook, Twitter or any other social network unless stated in the Promotion otherwise.
  20. If any ‘minimum purchase amount’ is indicated in an offer, taxes, shipping, handling and other charges may not be included in calculating such ‘minimum purchase amount’.
  21. If Your return any products/services purchased under the Promotion/Campaign, the refund will only be for the actual cash amount paid by You to the Seller (without the coupon value, if any) for the product/services and shall be subject to the refund policy.

Coupon Terms & Conditions

  1. The offer contained in the electronic communication ("E-Coupons") is  subject to You being a registered user ("Users") of www.ebay.in or m.ebay.in (“eBay Website”).  These terms and conditions are in addition to the eBay Website User Agreement, PaisaPay Agreement, Privacy Policy and other eBay Rules and Policies ("eBay UA & Policies").  The offer contained in the electronic communication (“E-Coupons”) is not intended to person resident outside India and minors and person incompetent to contract and any acceptance of offer and usage of E-Coupons by these persons shall be invalid and void ab-initio.  E-Coupons are also not offered to, and shall not be used by, such Users who under any statutory obligations are prohibited to use E-Coupons.
  2. E-Coupon is the property of eBay Website and eBay has the right to cancel/alter the E-Coupons at will and at any time (including during the validity period of the E-Coupon) without giving any prior intimation to the User or the coupon provider.  E-Coupon is a privilege and not a right or claim against eBay.  E-Coupons can also be cancelled in case the User is in violation of eBay UAs & Policies.
  3. A User using the E-Coupons in any manner shall be deemed to have read, understood and accepted these terms and conditions.
  4. E-Coupon issued to the Users  may be linked to specific User ID mentioned in the electronic communication.  E-Coupon cannot be used through another User ID even-though a different User ID is maintained by the same person.
  5. The value and the mode of using of the E-Coupon are mentioned in the electronic communication.
  6. E-Coupons shall be valid and must be redeemed as per the validity date mentioned along with the said coupon and/or along with communication of such coupon, unless cancelled/terminated earlier in accordance with these terms and conditions and/or eBay UAs & Policies.  The validity of E-Coupon shall be subject to the condition that the User remains registered user and has neither been suspended nor been in violation of eBay UAs & Policies and PaisaPay Payment services.
  7. E-Coupon offered by independent person/third-party companies/publishers to market or promote the listings on eBay Website are undertaken solely by such independent person or company or publisher, eBay shall not have any liability towards users in any manner whatsoever with respect to any offers/campaigns run by such person or third party companies or publishers.  Any offers/discounts/promotions offered/run by person/third party companies/publishers with respect to products listed on eBay Website, and claims with respect to the such offers/discounts/promotions shall be the responsibility of such person or third party companies or publishers only.
  8. E-Coupons can be redeemed,
    1. only before the listing has ended on eBay Website or the item is stock out (stock out means that the item is no longer available with the seller, or the seller for any reason is unable to list or sell or deliver the item); and
    2. only when payments are made through PasiaPay; and
    3. on the First-come, first use basis.  Please refer to marketing communication to ascertain the specific terms and condition as applicable.   
  9. E-Coupons shall be invalidated and your transaction shall be reversed, in case:
    1. Your payment has been rejected by eBay due to eBay's risk containment measures; or
    2. You bought the item which is illegal or prohibited by eBay UAs & Policies for transaction; or
    3. You bought the item which is required to be shipped outside India; or
    4. You have used the E-Coupons on Coins & Notes, Stamps, Gold Coins and items/categories other than what have been mentioned in marketing communication; or
    5. You have used/attempted to use E-Coupons on the listing where E-Coupons are not applicable.
  10. Unless specifically stated: (a) one E-Coupon can be used only for one purchase irrespective of the value of such purchase;  (b) unutilized or underutilized value of the E-Coupons cannot be carried forward and shall be forfeited;  (c) a user cannot claim any benefit or a substitute E-Coupon in lieu of the unutilized or underutilized value of the E-Coupon/s;  (d) where the purchase value of an item exceeds value of the E-Coupon, a buyer shall be required to pay the balance consideration to the seller at the time of payment.
  11. E-Coupon carries no cash value and cannot be exchanged, transferred, negotiated or sold and cannot be redeemed against cash.  E-Coupons cannot be combined with any other coupons or any other offer or discounts or promotions.  eBay shall not be responsible to compensate you in any manner for the unused/ invalidated E-Coupon including providing alternate E-Coupon.
  12. Shipping charges may be extra and as per the item listing provided by the seller.
  13. Disclaimers:
    1. eBay is not responsible for any typographical error leading to an invalid coupon.
    2. eBay does not guarantee that any one or more listings on eBay Website or the listings desired by the Users would have the option to use the said E-Coupon.
    3. eBay is neither recommending You to purchase the specific item which You intend to purchase or actually purchase using E-Coupon nor is eBay warranting or endorsing any product or services listed on eBay Website nor warranting or verifying or guaranteeing the performance of any product/service or conduct of any seller or any third party or publisher offering E-Coupon as a payment option.
    4. eBay shall not be liable for any lost or stolen E-Coupon, and E-Coupons once issued shall not be reissued.
  14. eBay makes no representation or warranties of any kind regarding any product or service provided by any third party in connection with any E-Coupon and shall not be responsible for any costs, damages, accident, delay, injury, loss, expense or inconvenience that may arise in connection with the use of E-Coupons.
  15. Limitation of Liability: Under no circumstances shall eBay's liability exceed giving the User a refund/replacement E-Coupon of the same nature and same value.
  16. These terms and conditions are subject to Indian laws and any dispute shall be subject to jurisdiction of the courts in Mumbai (India) only.

EBAY SELLER MARKETING PROGRAM - FAQs


  1. What is eBay Seller Marketing Program?

eBay Marketing Program is offered by eBay India for independent Sellers registered on eBay Website.  The objective of the Program is to encourage Sellers to offer great value, unique selection while creating economic opportunities to grow their businesses on eBay Website.  Sellers who choose to participate in the Program, may at their discretion, offer best prices to the existing or prospective buyers.  Sellers are encouraged to deliver consistently exceptional customer experience.  eBay may, at its sole discretion, promote the listings of such Sellers through its various marketing channels.

 

  1. What are these Offers and how I will know about these Offers?

eBay will communicate to Sellers about the Offer(s) under this Program on their registered email id subject to their fulfilling the Eligibility Criteria of the Program. There may be multiple Offers at a time and may vary for specified category(ies) and/or items/SKUs. Terms and conditions of Offers may vary.

 

  1. What is the Eligibility Criteria of the Program?

eBay may at its sole discretion determine certain eligibility criteria to identify sellers who may participate in the program. An indicative (not exhaustive) list of the criteria is provided below and Sellers may be required to meet any or all of the same. eBay may require that the seller score/exiting rating/level for the following criteria should be within the defined thresholds throughout the Offer Period.

  1. Seller must have a valid and active user id of eBay Website throughout the Offer Period and at scheduled date for payout of Incentive under the Offer.
  2. Seller must have its principal place of business in India.
  3. Seller must hold a valid Permanent Account Number (PAN) and Tax Identification Number (TIN).
  4. Seller Site Experience criteria such as Seller Make It Right (SMIR), Response Rate, Defect Rate, Ready to Ship (RTS) timelines, Auto INR (Auto Refund) and any other buyer/user/transaction metric that eBay may determine at its sole discretion.

 

  1. What is the Participation Process?

If you fulfill the aforementioned Eligibility Criteria, eBay will inform you about this program through an email on your registered email id and invite you for your participation in the same.

  1. You will receive a link in the said email to sign-in with your valid eBay user id and password.
  2. Upon successful sign-in, you will see the details of this Program.
  3. In order to enroll for your participation in this Program:
    1. you must read, understand and accept the terms & conditions of the Program;
    2. select the category(ies) for which you want to participate in the Offer under this Program; and
    3. click on “I Accept” button on this Program page.
  1. Upon your successful enrollment, you will receive another email communication from eBay containing the Offer details [such as SKU/models, Offer Period, Incentive details etc.] for the category(ies) you opted in.
  2. You will have to provide the details of your item Ids that you propose to include in the Offer (scheduled items/scheduled item IDs) and best offer price of specified SKU/Model under the category(ies) you opted in, to participate in the Offer in the prescribed format and timelines communicated to you.
  3. This will enable eBay to consider your participation in the Offer
  4. The incentive, if any, payable to sellers under this program shall be calculated only on the basis of such scheduled Item Ids.
  5. Seller while providing the scheduled items ids to participate in the Offer shall ensure to select the condition under Buyer Requirement as “Have bid on or bought my items within the last 10 days and met my limit of 1” for such item ids during the Offer Period. That means, a buyer can only buy one quantity from a particular listing of the seller within 10 days. If Seller(s) fails to select this condition on the scheduled item ids to participate in the Offer, Seller(s) shall not be eligible for the Incentive, if any, on the transaction(s) for multi-quantity purchase by the same user Id.
  6. eBay may, at its sole discretion, promote the listings of Sellers through its various marketing channels.
  7. Sellers may provide additional item ids of the specified SKU/Model in a predefined format to include in the Offer. eBay may, at its sole discretion, consider to include such additional item Ids in the Offer and shall confirm the same in writing to the Seller.

 

  1. How will my items get added for promotions?
    1. eBay shall share a spread sheet containing details of SKU/Model, their Recommended/Trending Price and Incentive offered thereon on your registered email address
    2. You will have to provide the details of your item Ids that you propose to include in the Offer (scheduled items/scheduled Item Ids) and best offer price of specified SKU/Model under the Category(ies) you opted in, to participate in the Offer in the prescribed format and timelines communicated to you.
    3. This will enable eBay to consider your participation in the Offer.
    4. You need to schedule your listings as per the guidelines mentioned in the email communication sent by eBay.
    5. eBay may, at its sole discretion, promote the listings of such Sellers through its various marketing channels.

 

  1. What is Recommended/Trending price?

Recommended/Trending Price of the product is an indicative price of the product basis some performance analysis on eBay Website and Sellers are recommended to list their products on such recommended/trending price which may help them to boost their sale. For avoidance of any doubts, it is clarified that the Recommended/Trending Price is mere guidance to the Sellers and Sellers may at their own discretion decide to follow it or not.

  1. Can I include my additional Item Ids during the Offer?

Sellers may provide additional Item Ids of their listings in the predefined format to include in the Offer.  eBay may at its sole discretion, consider to include such additional item Ids in the Offer.

  1. How my listings get selected for promotion by eBay?

Sellers who choose to participate in the Program may, at their discretion, offer the best prices of their items to the existing or prospective buyers on eBay. eBay may, at its sole discretion, promote the listings of such Sellers through its various marketing channels.

  1. What is incentive and how it will be calculated?

Incentive: A fixed amount and/or percentage value of listing price and/or both [as specified in the Offer] offered to pay by eBay to eligible Sellers who have completed successful transactions for the items specified in the Offer and subject to the terms and conditions of this Program.  The payment of Incentive is subject to provisions of the applicable tax laws.  

  1. What is Qualifying Transaction?

A successful transaction of the Seller on eBay Website during the Offer Period.  For the avoidance of any doubts, the transactions that are refunded [fully or partially] or cancelled subsequently or the products are either returned or disputed by the buyers for any reason whatsoever shall NOT qualify as a successful transaction. eBay may, at its sole discretion, include such additional criteria to identify Qualifying Transactions.

  1. To whom and when I need to raise my invoice and when I will receive the incentive amount?

You must raise a Tax invoice on eBay India Private Limited for the Incentive, if any, payable to you on your scheduled Item Ids considered for your participation in the Offer(s) under this Program.

  1. Within thirty (30) days from the closure of the Offer Period, eBay will review your: (a) Qualifying Transactions; and (b) compliance with terms and conditions of the Offer, Program and eBay UA & Policies.
  2. Once eBay completes its aforesaid review within thirty (30) days from the closure of Offer Period, Sellers will be able to view the qualifying Incentive in their Seller Dashboard.
  3. Seller needs to raise an Invoice in requested format [https://powership.ebay.in/diwali-seller-dashboard/invoice_format.pdf] with all necessary details for such Incentive amount on eBay India Private Limited within next ten (10) days and send it to Kind Attention: eBay Seller Promotion Team, MINTKART INDIA PRIVATE LIMITED (formerly eBay India Private Limited) No. 1261, 6th Floor, Building No. 12, Solitaire Corporate Park, No. 167, Guru HargovindJi Marg, Andheri (East), Mumbai - 400093, Maharashtra, India.
  4. Incentive amount for the transactions on which eBay Guarantee claims are open will be withheld by eBay till closure of such claims and shall be calculated only after next thirty (30) days upon closure of such eBay Guarantee cases in favor of Seller. Seller will be able to see the details of their transactions on which eBay Guarantee claims are open.
  5. Incentive payable under the terms and conditions of the Offer(s) and Program will be subject to provisions of applicable tax laws and regulations.

  1. Do I need to submit any other documents with my Invoice?

You need to provide the following documents (a) Permanent Account Number (PAN), (b) Know Your Customer (KYC), (c) Service Tax Registration Number, (d) any other documents requested by eBay.

  1. When and How will I be receiving the incentive amount?

eBay will credit the payment of your Incentive in your bank account within 15 (fifteen) business days from the date of receipt of your undisputed invoice.

  1. What is the Seller Dashboard? Where will I be able to view the Dashboard? How frequently will the Dashboard be refreshed?

During the Offer, Sellers participating in the Offer will be able to view a Seller Dashboard https://powership.ebay.in/diwali-seller-dashboard/ which will contain the details of their qualifying transactions, open claims under eBay Guarantee against Seller’s transactions with a lag period and other information as communicated in the Seller Dashboard.

Buyers

  1. What are eBay gift vouchers?

    eBay gift vouchers are an additional way of paying for items bought on eBay India using PaisaPay (besides Credit Card, Debit Card   and Online Bank Transfer). Your gift voucher will consist of a 10-digit alphanumeric code that you can enter while paying for the item using PaisaPay

  2. What kind of payment types do gift vouchers provide?

    Gift vouchers can be of two types:

    • Flat value: For example, get Rs. 100 off on purchases of Rs. 200 and above.
    • Percentage: For example, get 20% off on purchases of Rs. 1000 and above.
  3. What are the terms and conditions of using gift vouchers?

    How can I get a gift voucher?
    • Each voucher will have its individual criteria, such as minimum order amount, seller / category / item against which the voucher is applicable.
    • Vouchers will have a validity period, which will vary from voucher to voucher.
    • Vouchers can only be used with PaisaPay, that is, if a coupon is a % discount type, then the balance amount can be paid by Credit Card, Debit Card or Online Bank Transfer with  PaisaPay.
    • Each gift voucher is good for one-time use only. You will not be able to split the value of a voucher across multiple payments or using more than one voucher at a time.
    • Gift vouchers are not redeemable against the items listed under Deals of the Week or any other offer.
    • Each voucher is User Id specific .So the voucher issued on your eBay ID cannot be used to avail discounts on any other eBay User ID.
  4. I have received a gift voucher. What do I do?

    When you buy a Buy It Now item or pay for the item that you have won on www.eBay.in , choose to pay with PaisaPay. On the PaisaPay payment page, enter the 10 digit alphanumeric gift voucher code provided to you and click the Apply button.

    Once the voucher is validated, the order details at the top of the page will reflect the changes, and will indicate the balance amount to be paid using Credit Card, Debit Card or Online Bank transfer. Complete your payment and click the Pay button

  5. Will I have to pay something to redeem a gift voucher?

    No, eBay gift vouchers are absolutely free for buyers.

  6. What happens to my voucher in case I'm eligible for a PaisaPay refund?

    If you're eligible for a refund, you will receive the entire amount you paid for the order using online bank transfer or credit card. The amount will be refunded back to the same Credit Card or Bank account from where the initial payment was made. For example, if you paid using online bank transfer, the amount will be transferred back to your bank account. You will not, however, be able to re-use the gift voucher. In some cases, eBay may issue a new voucher at its own discretion but, not necessarily of the same value.

  1. How can I ensure that my items are eligible for gift voucher purchase?

    All you need to do is offer PaisaPay on your listings, and vouchers will be redeemable against your listings (depending on the terms and conditions of the specific vouchers).

  2. What will it cost me if buyers pay for my item using an eBay gift voucher?

    You will be charged the same PaisaPay fees as the payment type used by the buyer for paying the balance amount. So, for a Rs. 100 order, buyer has paid Rs. 80 using credit card and Rs. 20 using vouchers, sellers will be charged the PaisaPay Credit Card fees for the entire Rs. 100. If the buyer had paid Rs. 80 using online bank transfer, and Rs. 20 as vouchers, the seller will be charged the PaisaPay online bank transfer fees for the entire Rs. 100. In case the amount is fully paid for using vouchers, then coupon fees rate will be 4.5% plus Applicable taxes on the total purchase amount.

  3. Can I buy gift vouchers?

    No, you will not be able to buy vouchers. eBay will distribute coupons directly to users, at its own discretion.

Terms & Conditions

These Terms and Conditions ("Terms") apply to the PAYBACK Loyalty Program offered by eBay India, and are in addition to and not in derogation of the terms and conditions mentioned in the User Agreement, Privacy Policy and other Policies of www.ebay.in ("eBay website") (further referred to as "eBay UA & Policies"). To the extent of any inconsistency between these Terms and eBay UA & Policies, the eBay UA & Policies shall prevail.

Definitions

In these Terms and Conditions the following words and phrases shall have the meaning set below, unless the context indicates otherwise, and may be modified from time to time.

  1. "Program" shall mean the PAYBACK Loyalty Program offered by eBay India in collaboration with PAYBACK (defined below).
  2. "Reward Points" or "PAYPACK Points" shall mean the points awarded by PAYBACK under the Program.
  3. "PAYBACK" shall mean Loyalty Solutions & Research Pvt. Limited, a company incorporated under the Indian Companies Act, 1956 and having its registered office at 4th & 5th Floors, Kabra Excelsior, #6A, 7th Main, 1st Block, Koramangala Industrial Layout, Bangalore - 560 034 and such expression shall, unless it be repugnant to the subject or context thereof, include its successors, assigns, representatives and transferees.
  4. "PAYBACK member" means the customer/s or user/s who is/are also enrolled as a member of PAYBACK with a PAYBACK Account.
  5. "PAYBACK Card" means and includes the card issued by PAYBACK to its member/s for redeeming/ earning the Reward Points that is accumulated in their respective PAYBACK Account as per the terms and conditions specified by PAYBACK.
  6. "PAYBACK Account" shall mean the account opened with PAYBACK in the name of the customer/s or user/s for the purpose of accumulating the Reward Points earned by them under PAYBACK Loyalty Program.
  7. "Effective Date" shall mean the date from which the Program commences on eBay website.
  8. The user can now earn nor redeem PAYBACK points on COD (Cash on Delivery) transaction through eBay website
  9. "Redeem PAYBACK Points" shall mean a user will select the PAYBACK points out of the accumulated points available in its PAYBACK Account to be redeemed and click on "Redeem Now" to redeem such PAYBACK points during the transaction. Once user redeems its PAYBACK points, such points will be instantly deducted from its PAYBACK Account.
  10. "Earn PAYBACK Point" shall mean a user will be awarded the PAYBACK points that will reflect in the user's PAYBACK account in 4 (four) days from the user's transaction on eBay website. The Payback points thereby earned will be in a blocked state and will only be unblock?d post 45 days from the date of transactions for the user to redeem the same.
  11. "Drop-offs" shall mean an event(s) when a user selects its PAYABCK points and clicks on 'Redeem Now' for their redemption, but does not proceed further and/or is unable to complete the transaction, for any reason whatsoever, i.e. fails to make the payment for the goods/products.
  12. "Refund" shall mean a transaction wherein user's claim has been allowed and approved for refund by eBay.

General Terms & Conditions:

  1. This program (redemption ONLY) is live from January 09, 2014. The PAYBACK EARN process will be live on www.ebay.in with effective from June 20, 2014. With PAYBACK Loyalty Program the user can now Redeem and/or Earn PAYBACK Reward points on their transactions made on eBay website.
  2. For the sake of these Terms, "Customer/s" or "User/s" shall only include resident Indian eBay registered user/s.
  3. Requirement for Participation: The user should hold an active eBay India account and a valid PAYBACK account. User must link their PAYBACK Account to its eBay India account to participate in the Program. A user shall be allowed to link only one of its PAYBACK accounts at a time. However, the user may choose to de-link the existing linked PAYBACK account from the eBay India Account, and may link a new PAYBACK account, if any.
  4. The PAYBACK points shown in the transaction flow is as per the records of PAYBACK Account of user maintained at the end of PAYBACK.
  5. A user can earn or redeem or both the PAYBACK points in a single transaction. However, the user will not earn any PAYBACK points on its transaction for the purchase of Promotional/ discounted item in the form of coupon or subsidy(s) on eBay website.
  6. A user can redeem its PAYBACK Points during its transaction on Promotional/discounted item(s).
  7. The user will be allowed to apply coupon only before redemption of PAYBACK points in the transaction flow. In other words, a user who is willing to use an eBay coupon in a transaction can apply the coupon only before redemption of its PAYBACK points.
  8. The PAYBACK Points redeemed by the user under this Program will be forthwith deducted from its PAYBACK Account.
  9. In case of Drop-Offs, the PAYBACK points deducted from the user's PAYBACK Account will be credited/ refunded back to the user's PAYBACK account within 2 hours of the transaction.
  10. In an event of refund, the PAYBACK points redeemed for a particular transaction will be credited/ refunded back to the user's PAYBACK account within 4 (four) working days based on the action taken by the Customer Support team.
  11. The PAYBACK points earned by the user on its successful transaction on eBay website will be credited in the user's linked PAYBACK account within 5 (five) days from payment confirmation and would remain in a blocked state for a period of 45 (forty five) days from the date of credit of the PAYBACK Points in its PAYBACK Account. The user can use such earned PAYBACK Points after aforesaid period of 45 (forty five) days.
  12. The PAYBACK points earned by the customer will be valid for a period of 3 years from the date the points get credited ?nto the customers PAYBACK account.
  13. The Reward Points earned by user(s)/customer(s) can be redeemed by the user(s)/customer/s in the form and manner prescribed by PAYBACK in this regard.
  14. In the event the transaction wherein user's claim has been allowed and approved for refund by eBay, the points earned by the user and are reflecting in a blocked state will be reversed/ removed from the user's PAYBACK Accounts on the completion of the reversal/ refund process.
  15. User in order to participate in the Program shall agree the Terms and Conditions mentioned herein, and shall also be governed by the terms and conditions of PAYBACK hosted on its website www.payback.in. In case of any contradiction between these Terms and Conditions and the terms and conditions hosted on the PAYBACK website, the former shall prevail.
  16. User shall raise its grievances in relation to PAYBACK Points under this Program directly with PAYBACK without any reference or recourse to eBay. eBay or eBay website, and/or its employees/ representatives shall not be liable, in any manner whatsoever, for any disputes, claims, damage, cost, expenses which may arise out of or in connection with this PAYBACK Loyalty Program between the user(s) and PAYBACK for any reason whatsoever.
  17. The Loyalty Program is complimentary and it is hereby understood that all transaction charges on Eligible Transactions on the basis of which the Reward Points are assigned to the customer, are voluntarily incurred by a customer in the normal course of their making transactions on eBay website. Further, nothing contained herein shall prejudice or affect the terms and conditions governing the operation of eBay or its website.
  18. eBay and its website expressly reserves the right, at any time and without prior notice to the Customer/s, to add and/or alter, modify, change or vary all or in part, this Program or to withdraw the Program altogether.
  19. On redemption, the Reward Points so redeemed shall automatically stand reduced from the accumulated Reward Points in the PAYBACK Account. Computation of the Reward Points shall be final, conclusive and binding on the customer/s and will not be liable to any dispute or questioning.
  20. Any tax(es) or charges payable to the Government or any other authority or body which may arise or accrue to the customer/s by redemption as aforesaid or otherwise as a result of this Reward Program, shall be borne by the customer/s or user/s.
  21. The existence of a dispute, if any, under this Program shall not constitute a claim against eBay or eBay website.
  22. In all matters relating to the conduct of this Program the decision of eBay or eBay website shall be final and binding in all respects.
  23. The customer/s or user/s cannot transfer, assign or bequeath Reward Points accumulated under this Program to any another person under any circumstances.
  24. eBay or eBay website makes no warranties or representations either expressed or implied, with regard to the type, quality or fitness of the goods/benefits received through PAYBACK.
  25. Whether an Eligible Transaction is considered to be valid for the purpose of redeeming Reward Points shall be the sole discretion of eBay or eBay website. If the customer/s reverses an Eligible Transaction/s on which Reward Points were redeemed, Reward Points redeemed for such reversed transactions will also be reversed. That means in case of refunds, the redeemed points will also be refunded to the user within 4 (four) working days from the time the refund process is initiated by eBay.
  26. Nothing contained in this Reward Program shall be construed as a binding obligation upon eBay or eBay Website to continue the Reward Program or in the event of the termination of the Program or otherwise.
  27. Disputes, if any, arising out of or in connection with, or?as a result of this Reward Program or otherwise shall be subject to the laws of India and the exclusive jurisdiction of the competent courts in Mumbai only.

When do I Earn Payback points?

You will earn Payback points:

  • When you purchase an item on eBay India that isn?t pre-discounted or promoted.on- This includes coupons, deals, subsidized items, gift promotions, flash sales, etc.
  • On a transaction where you have only redeemed Payback points, you can also EARN Payback points on the payable order amount.

For instance, if you purchase item worth Rs.100 and you redeem PAYBACK points worth Rs.50/-, then on the balance Payable Order amount (Rs.50/-), you can earn PAYBACK points.

Please note: You will only earn Payback points in this scenario if you haven't applied any coupon to the transaction or bought any promoted/deal item.

When do I not Earn Payback Points?

You will not be allowed to Earn Payback points in the following scenario.

  • If you do not have a valid Payback account/ have not linked your Payback account.
  • You will not be allowed to earn Payback points on items that are already discounted/ promoted merchandise in the form of coupons, deals/subsidy, gift promotions, flash sales etc.

An appropriate error message will be thrown in such cases.

What happens when I club a promoted and non-promoted item into a cart and make a single transaction? Do I earn Payback points on the same?

You will earn Payback points on the non-promoted/ non-discounted item and will not earn any Payback points on the promoted/discounted item. But in case you do apply a coupon to this cart, the coupon will be applied to the non-promoted item thereby not allowing you to earn any Payback points on the transaction.
