Terms and Conditions for the "Smart Summer Shopper Contest"



These "Terms and Conditions" are being entered into between eBay International AG (including its affiliates, holding & subsidiary companies) (individually and collectively be known as "eBay") and all registered users ("You") at www.ebay.in ("Site") who enter the "Smart Summer Shopper Contest" ("Contest"). By clicking on / checking on "I Accept" button / option. You unconditionally agree to be bound by these Terms and Conditions.  





Contest Batches and Contest Period

The Contest shall be in two (2) batches. The first batch of Contest will start on 4th day of May, 2006 (00:00:01 hours) and shall end on 10th day of May 2006 (23:59:59 hours) and the second batch of Contest will start on 11th day of May, 2006 (00:00:01 hours) and shall end on 17th day of May 2006 (23:59:59 hours) (hereby collectively called as "Contest Period"). 



Eligibility Criterion for participation in the Contest and getting/being rewarded:

1)	The user will need to pick item ids of items that he wishes to buy from www.ebay.in as part of his summer wardrobe

2)	The user will then need to post a link to the item, the total cost of the item on the Contest thread (hereinafter the "Thread") created on eBay.in Community Forum.

3)	Along with posting links to the items, the user would be required to answer a question posted at the Thread.

4)	You should not be in violation of the User Agreement, Trust & Safety rules and any other applicable policies on the Site.

5)	Your account at the Site should not have "suspended" or "on hold" status.





Winning Criterion & Reward:

1)	Winning Criterion:

a)	Post a minimum of five (5) item IDs.

b)	Variety of collection.

c)	Taste / Quality of the collection

2)	Registered users fulfilling the Winning Criterion and giving correct answer pf the question shall be eligible to win a gift hamper from eBay.

3)	There shall be two (2) winners of each batch of this Contest.

4)	The winners of the first batch shall not be declared as winner of the second batch.

5)	The lucky winner will be selected by an independent third party. The judges' will choose winners and no correspondence will be entertained regarding the final decision, which shall be at the sole discretion of the third party agency. 

6)	The winners of the first batch would be declared on 12th day of May 2006 and the winners of the second batch would be declared on 19th day of May 2006. 

7)	The winners will be intimated by email or the telephone number at the email address / telephone number provided at the time of registration on the Site. The user IDs of the winners would also be announced on the eBay.in discussion board on the respective dates of declaration of result. If eBay is not able to contact the winner by midnight seven days after eBay's first attempted notification, eBay reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse.

8)	eBay or the administrator of this Contest would undertake reasonable efforts to deliver the prize (which will be free of any shipment charges) within 45 days from the date of declaration of results, but this is subject to variation by the suppliers of the prize. eBay or the administrator shall not be liable or held accountable for any delay in delivery of the prize.

9)	eBay or the administrator shall not obtain any shipment / delivery related insurance for delivery of the prizes. The winner shall assume the risk of damage, destruction or loss of prizes during transit.

10)	All product and service related issues/warranties are the responsibility of the manufacturer of the prize item. eBay is neither responsible nor guarantees the quality of the prize items, nor it is liable for any defect or deficiency or shortcoming or any risk associated with the prize items.





Miscellaneous: 

1.	eBay  reserves the right at anytime, without previous notice, to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this Contest by another Contest, whether similar to this Contest or not, or to withdraw it altogether. You hereby agree to be bound by such revised Terms and Conditions. 

2.	All decisions by eBay regarding the selection of winners shall be final and binding. No correspondence or appeals will be entertained in this regard.

3.	The employees and the immediate family members of the employees of eBay and its associate companies shall not be eligible to participate in the Contest.

4.	eBay does not warrant that the Site and/or the Categories’ home pages will run concurrently and error free during or after the Contest Period and does not commit any uptime of the Site and/or the Categories’ home pages. 

5.	eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds participants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Contest.

6.	You understand and agree that participation in the Contest for the purpose of being rewarded to be promoted is good and sufficient consideration for You to agree and bound by these Terms and Conditions.

7.	Any and all taxes, including without limitation income tax and/or service tax, if any applicable on this Contest and the rewards thereto shall be borne by You and You shall deposit the applicable amount of taxes to eBay before You could avail any rewards, unless otherwise mandated under the applicable laws.

8.	Any disputes arising out of this Contest shall be subject to the exclusive jurisdiction of competent courts in Mumbai irrespective of whether courts in other areas have concurrent or similar Jurisdiction.
