	Terms and Conditions Terms & Conditions - eBay House Contest These Terms & Conditions are being entered into between eBay International AG (eBay International AG & its affiliates, holding & subsidiary companies shall collectively be known as "eBay") & all participants who enter the eBay House Contest shall be bound by the following terms and conditions (hereinafter the "Contest") on www.ebay.in ("Site").: 1. The Contest is open to all Users who are registered as Users and have never listed any item for sale on eBay.in and whose country of residence is India, except any employees (and their families) of eBay India Pvt. Ltd, any affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be involved with the Contest "eBay House". eBay reserves the right to verify the eligibility of entrants. 2. In order to participate in the Contest, the following rules need to be followed:- The User would need to list their first item successfully for sale on eBay.in between 00:00:01 am IST Monday 21st November and 23:59:59 pm IST Monday 26th December, 2005 (the "Contest Period"). Any listing beyond this time period shall not be considered eligible for the Contest. 3. User needs to successfully list their first item for sale during the contest period. By doing this, the user automatically gets enrolled for a sweepstake where the one lucky user stands a chance to win a Grand prize which includes one LG AC model number LWA18G1RAE1, one LG Microwave model number MC-8083 and one LG Refrigerator model number GLT322GP. Additionally, there are 15 runners-up who will receive eBay goodies pack containing an eBay bag, T shirt, Silver coin & pen. Paisapay - User can also win an additional prize which includes an LG 29" Flat Televison model number 29FD55VE and LG DVD player model number DSI-8556, if the user accepts PaisaPay and offers Paisapay as the payment mode for the first item displayed on the Site for sale during this Contest. 4. The lucky winners will be selected by a third party on the basis of quality of their listing. This is a game of skill and winners will be chosen based on the use of eBay's features, quality of information and photographs and design of listing. The judges' will choose the grand prize winner plus fifteen runner's up and no correspondence will be entered regarding the final decision, which shall be at the sole discretion of the third party agency. All winners will be notified by e-mail address/ or telephone number as supplied by the User upon registration with eBay, no later than January 15th, 2005. The address of the eBay user should be a verifiable offline address. In the event of the address of the user being a non verifiable one, eBay reserves the right to cancel the entry of the user, and to select an alternative winner. In order to be eligible to receive a prize, winner's eBay account must be in good standing, including feedback not below zero during the period of this promotion. The prizes are non-encashable and any government levies/taxes like service tax, Sales Tax, TDS, any Local Tax etc. arising out of the same will be borne by the winners. 5. If eBay is not able to contact the lucky draw winner by midnight seven days after eBay's first attempted notification, eBay reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse. 6. Depending on the prize won, the winners would receive the prizes (which will be free of any shipment charges). We aim to have all prizes delivered within 45 days from the date of announcing the winners, but for certain prizes this is subject to variation by the suppliers. In the event of the possibility of prizes not being deliverable to winners the winners would need to collect the same from the office of eBay. 7. No cash alternatives will be substituted for consolation prizes. 8. eBay reserves the right to add additional terms and conditions as part of the Contest. 9. If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants. 10. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the Contest, eBay reserves the right to suspend, change or cancel the Contest at any time. 11. eBay reserve the right at anytime, without previous notice, to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this scheme by another scheme, whether similar to this scheme or not, or to withdraw it altogether. 12. eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Contest. 13. eBay is the organiser of the Contest. eBay may carry out this Contest through its agents and partners. eBay may use third parties to facilitate one or more elements of this Contest 14. The lucky draw prizes are subject to availability of products and services at the time of giving away the prize. In case of non availability of products / services the same is subject to change. eBay will notify the winner in case of such a circumstance 15. Any disputes arising out of this Program shall be subject to the exclusive jurisdiction of competent courts in Mumbai irrespective of whether Courts in other areas have concurrent or similar Jurisdiction, unless stated otherwise elsewhere in the Terms and Conditions. The existence of a dispute, if any, shall not constitute a claim against eBay. 16. Residents of the State of Tamil Nadu shall not be entitled to participate in the said lucky draw part of the Contest 17. All taxes & TDS applicable to be borne by the winners. 18. All service related issues/warranties are the responsibility of the manufacturer or the respective third party service provider. 19. eBay is neither responsible nor guarantees the quality of goods /services at the participating establishments, nor it is liable for any defect or deficiency or shortcoming or facilitating processes of the goods/services so obtained/availed or redeemed by eBay users.
