DHANBOLA PROMOTION - TERMS AND CONDITIONS

The promotion “Dhanbola Promotion” (hereinafter “Promotion”) is offered by eBay India Private Limited (“eBay”) and is applicable to registered users of eBay Website (as defined below).

1. Definitions:

1. “Dhanbola” shall mean an engagement event through housie/bingo play being hosted by eBay on its eBay India Social Account through a Facebook live video for its eligible Users on Promotion Event" as per the rules of the Dhanbola set out by eBay
2. “eBay Website” shall mean www.ebay.in and/or m.ebay.in 
3. “User/s” shall mean registered users of eBay Website who have their registered addresses in India only and are presently residing in India
4. “Promotion Event” shall mean the Dhanbola event scheduled on 25th October 2016 at 16:00 hrs
5. “Promotion Period” shall mean 15th September 2016 to 19th October 2016
6. “eBay India Social Account” shall mean www.facebook.com/ebaydotin official Facebook page
7. “Ticket/s” shall mean the Dhanbola ticket with combination of maximum 15 numbers that is a part of the 1-90 number set, including but not limited to, regular ticket and special ticket, received by the eligible User from eBay at free of cost through an email to his/her registered email Id on eBay Website.
8. “Host” shall mean an individual/service provider appointed by eBay who shall conduct the Dhanbola on the eBay India Social Account through the Facebook live video and announce the numbers/winners of the Promotion on Promotion Event
9. “Ticket ID” shall mean a unique reference number allotted to each Ticket by eBay under this Promotion .
10. “Prize Category” shall mean the five prize categories of the Dhanbola, such as Early 5, First Row, Second Row, Third Row, and Full House

2. Eligibility:

1. The Promotion is valid only for Users of eBay Website
2. User’s registered email Id with eBay Website must be valid and active during the Promotion
3. User/Participant must be 18 years of age or above in order to participate in the Promotion
4. User must have a valid and active Facebook account in order to participate and comment on eBay India Social Account during the Promotion Event
5. Users who have received the Tickets and registered their Ticket ID(s) with eBay confirming their participation in the Dhanbola on or before 25th October 2016 (11:00 hrs)
6. User must correctly answer the multiple choice question(s) while registering their Ticket ID(s) in order to participate in the Promotion

3. Participation process:

1. If you fulfill the Eligibility criteria mentioned above, you will receive the Ticket/s from eBay by 22nd October 2016 on your registered email ID with eBay Website. The following category of Tickets will be issued to User:

* The Users who have transacted during the Promotion Period on eBay Website

Note: In order to calculate the transaction amount under this Promotion, only net transaction amount (excluding the discount coupon(s) and/or redemption of PAYBACK Loyalty Rewards Point) paid by the User in his/her one or more transactions shall be considered.

1. Every User will receive 1 (one) Ticket from eBay under the Promotion.
2. A User transacted during the Promotion Period is eligible to receive a special Ticket from eBay under the Promotion regardless of their number of transactions during the Promotion Period.  The top transaction of the User during the Promotion Period shall be considered and eligible for a special Ticket.

Examples:

1. If the User makes a single transaction on eBay Website of INR 7,000 during the Promotion Period mentioned above, then he/she is eligible for only one Ticket (i.e. Gold Ticket) under the Promotion 
2. If the User makes multiple transactions on eBay Website on one or more days during the Promotion Period mentioned above [let’s say, on Day1 he/she does two transactions for INR 12,000 and INR 6,000; and on Day2 he/she does a transaction for INR 15,000], eBay shall provide a special Ticket for the top transaction during the Promotion Period [in this example, the top transaction would be 15,000] of all the transaction(s) made by the User during the Promotion Period.  In such case, he/she is eligible to 1 Gold Ticket from eBay under this Promotion
3. In the event if User has not transacted during the Promotion Period and he/she has fulfilled the above-mentioned eligibility criteria, then you will be eligible for regular Ticket under the Promotion.  In any case a User will not receive more than 1 (one) ticket under the Promotion

 

4. The User should check his/her active email to access the Ticket/s, including but not limited to spam or junk folders
5. The User who have unsubscribed or opted not to receive eBay’s marketing/promotional offer communication will not get a Ticket under the Promotion
6. The eligible Users who have received the Ticket from eBay must register their Ticket ID/s on http://dailycdn.ebay.in/dhanbola/registration/index.html provided by in the email communication on or before 25th October 2016 (11:00 hrs) confirming their participation to play the Dhanbola
7. User must correctly answer the multiple choice question(s) while registering their Ticket ID(s) in order to participate and play the Dhanbola
8. Watch the live streaming of the Dhanbola on eBay India Social Account through Facebook live video on Promotion Event in order to play and participate in the Dhanbola
9. The Host will announce the numbers one by one. You must match them with the ones in your unique Ticket/s to get a chance to win prizes
10. The User must be attentive during the Promotion Event and no request for repetition of numbers will be entertained
11. If you have completed any of the Prize Category, you must promptly comment with Ticket ID on the relevant Prize Category post of eBay India Social Account during the Promotion Event at the earliest (For Example: Ticket ID: EU3TX).  eBay will upload the Prize Category post on eBay India Social Account on or before 25th October 2016 (i.e. Early 5, First Row, Second Row, Third Row & Full House).
12. Winners will be selected and announced on the first come first serve basis
13. Any entry submitted on comment section of Facebook live video, any other medium/space or destination other than the comment section of relevant Prize Category post of eBay India Social Account shall not be considered under the Promotion
14. eBay will announce the winners on Facebook live video and via post on eBay India Social Account during the Promotion Event

4. Rules of the Dhanbola and Prizes:

1. Dhanbola is similar to Housie/Bingo, in which the Host of the Dhanbola announces each number in a fair and random selection on the Promotion Event
2. A Ticket that has a combination of maximum 15 numbers (i.e. part of the 1-90 number set). It contains 3 rows and 9 columns:
   - the first column containing numbers between 1-10
   - the second column containing numbers between 11-20
   - the third column containing numbers between 21-30 and so on till the ninth column containing numbers between 81-90
3. The User must complete the numbers on his/her Ticket/s that matches the numbers announced by Host to be able to complete the numbers on his/her ticket at the earliest in order to win the prizes under the Promotion
4. Below are the five Prize Category under the Promotion:

5. The Users to submit/comment first with Ticket ID on the relevant Prize Category post of eBay India Social Account will be gratified.  All the submission will be cross-checked and verified by eBay to match the eligibility criteria for winning the Prize Category under the Promotion
6. The Dhanbola will proceed till the last winner of the Dhanbola’ Full House is declared for the Promotion.
7. The User who submitted/commented first and declared as winner by eBay shall not be eligible to participate further with that Ticket ID in the Dhanbola. In short, you can only claim for one prize per Ticket.  If you have claimed for multiple prizes, the first one you have claimed will be considered as the final prize. (For example: If you have claimed for Early 5 and Full house in this sequence, you will only be eligible to win the prize for Early 5 under the Promotion)

5. Winner selection criteria:

1. Winners will be selected on the first come first serve basis, depending upon the time of submitting their entry/comment on the Prize Category post of eBay India Social Account during the Promotion Event.
2. In case of a tie, the User who first registered his/her Ticket ID for participation in the Dhanbola with eBay shall be considered as winner.
3. eBay will request the winners through a message from eBay India Social Account to send the contact details (such as name, address, email Id and contact details) within 7 (seven) days of announcement date in order to dispatch the winning prize. If the winner/participant fails to send the requested details, eBay will send the prize at the address registered with eBay Website.
4. The prizes will be dispatched to the winners within 45 (forty five) days on the address shared by the User

6. General Terms and Conditions

1. You/ Your (means the person using/participation in this Promotion/Campaign with the intent to receive gift under this Promotion, or the User) should not be in violation and agree to abide with the terms and conditions of the User Agreement, PaisaPay Policy and other eBay Rules and Policies of eBay Website in addition to the terms and conditions of this Promotion.
2. eBay reserves the right at any time to amend/ add/ remove/ modify (in whole or part) any of the Terms & Conditions of this Promotion, or to replace, wholly or in part, this Promotion by another Promotion, whether similar to this Promotion or not, or to withdraw it altogether, and eBay's decision in this regard shall be final.
3. eBay, at its sole discretion, may also provide the Tickets to its Users as per the criteria solely determined by eBay.  eBay shall not entertain any queries or dispute in this regard in any manner whatsoever.
4. Tickets are issued at free of cost by eBay to the User under the Promotion.
5. All decisions of eBay regarding running /process /results of the Promotion shall be final and binding on You. No appeals shall be entertained in this regard.
6. The information shared by participants with eBay will be strictly for eBay to contact participants for further interaction related to events, special offers, etc. from eBay.
7. Participant shall not use any offensive, defamatory, slag or vulgar comments under this Promotion
8. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, substitute, change or cancel the Promotion, eBay reserves the right to suspend, change, substitute or cancel the Promotion at any time.
9. If eBay has suspicion or knowledge, that any entrant/user has been involved in any fraudulent or illegal activity related to this Promotion or You have violated the eBay Website User Agreement and any other Agreements or eBay Rules and Policies and processes of eBay Website, eBay reserves the right to disqualify that entrant/user and any related entrants. Any entrant user of eBay Website who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant user and its related user id's on eBay Website.
10. eBay does not warrant that eBay Website/eBay India Social Account will run concurrently and error free during or after the Promotion Period/Promotion Event and does not commit any uptime of eBay Website/eBay India Social Account. Further eBay shall not be liable for issues related to technical, human error whatsoever e.g. wrong Promotion number being entered by You or You being logged out of system without completing transaction.
11. eBay does not accept, and is not responsible for, any lost or delayed data, communication. eBay reminds You of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay that may affect entry/participation to the Promotion.
12. The items are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and You, as also complying with applicable law of the land.
13. eBay is neither responsible nor guarantees the make, quality of the product, items, which is purely responsibility, liability of third party. Nor is eBay liable for any defect, deficiency, shortcoming or any risk associated with the quality, commitment, deliver timeline of the products, items.
14. Please Note that if Your eBay Website user ID or PaisaPay access gets suspended from eBay Website. You will not be eligible to receive the gift under this Promotion.
15. eBay, as the context may require, will make every attempt to dispatch/email the gift or e-coupon code, however in case of a stock out situation in the market, eBay at its sole discretion will provide a similar gift or e-coupon code of the same or higher value.
16. The administrator of this Promotion would undertake reasonable efforts to complete the process of declaration of results (unless context otherwise require), verify and dispatch the gift/e-coupon code by within the stipulated period mentioned in the terms and conditions of the promotion. However, this is subject to no delays being caused by third party vendors or Force Majeure. eBay however shall not assume the risk of insurance and other related security, features, liability during transit.
17. For certain states within India, the prescribed Forms/applications/permissions are required by the courier company for dispatch of the free gifts. Upon the request by the courier company, the registered buyer/winner is responsible for providing the courier company with the aforementioned or any other requisite Form(s)/documents to receive the free gift.  In no manner eBay of the Promotion shall be responsible to submit the abovementioned Form(s)/documents to courier company.
18. You understand and agree that the above referred gift(s)/e-coupon code are gratuitous gifts, and participation in the Promotion is good and sufficient consideration for You to agree and be bound by these Terms and Conditions. In case any violation of Promotion Terms and Conditions and eBay Website User Agreements and other Website Agreements and policies and processes, You will not be eligible to receive gift or e-coupon code.
19. Any and all taxes, including without any limitation income tax (if any) applicable on this Promotion and the rewards/ benefits thereto shall be borne by You and You shall deposit the applicable amount of taxes (if any) to eBay/ contract administrator/ applicable governmental authorities before You/user could avail any benefits, unless otherwise mandated under the applicable laws.
20. All communications with You will be, on Your email ID and/or mobile number registered with eBay Website and/or community board.
21. The gifts/e-coupon code offered under the Promotion shall not be transferable. Cash alternative for the gifts/e-coupon code stated above may be given at the sole discretion of eBay. Mere participation in the Promotion shall not entitle a participant to a gift/e-coupon code. No other person or agent can claim the gift/e-coupon code on behalf of the Winner.
22. The employees and the immediate family members of the employees of eBay and its associate companies are NOT eligible to participate in the Promotion.
23. This Promotion is in no way affiliated with or sponsored by Facebook, Twitter or any other social network unless stated in the Promotion otherwise.
