Terms and condition for the promotional cash back offer
This promotional offer of cash back ("Promotion") made by eBay International AG ("eBay") is available only for all Credit Card Holders of SBI Cards & Payment Services Private Limited ("SBICPSL") as may be decided by SBICPPSL at its sole option and discretion.
"Customer" shall mean such customers to whom SBICPSL has issued and authorized to hold an SBI Credit Card who transacts on www.ebay.in ("Website") during the term of Promotion Period and makes the payment for such transaction on the Website through the Credit Card held with SBICPSL by using PaisaPay which is owned by eBay International AG, and which is an online purchase consideration disbursement facility provided by eBay on the Website, subject to the terms and conditions as provided herein and the Website User Agreement and policies.
This Promotion is only for the Website registered users ("Users") who are persons residents in India and 18 years of age or older and/or are persons competent to contract. These Terms and Conditions are in addition to the existing Website User Agreement and other policies and specific terms and conditions for this Promotion on the Website ("eBay UAs"). "User Agreement" shall mean the eBay user agreement as provided on the Website and presently under the URL https://pages.ebay.in/help/policies/user-agreement.html .
Privity of contract is between the Cardholder and SBI Card and in turn between SBI Card and eBay by virtue of an agreement.
"Promotion Code" shall mean a 10-digit alphanumeric electronic code which, when used by the Customer during the transaction on the Website as a User, will entitle Users to avail cash back as described below from eBay subject to the Terms and Conditions of this Promotion, eBay UAs.
For purchases upto Rs. 2,499/- the discount shall be 7.5% of the transaction value.
For purchases between Rs. 2,500/- and Rs. 4,999/- the discount shall be 10.0% of the transaction value.
For purchases greater than Rs. 5,000/- the discount shall be 15.0% of the transaction value or Rs. 1,000/- whichever is lower.
The Promotion Code can be used on all items/ products on the Website which offers PaisaPay facility and only during the Promotion Period. Promotion Code brings cash back for the Users as mentioned above subject to the Terms and Conditions of this Promotion and eBay UAs , which shall be computed and credited to the customer's credit card account within 21 working days of the transaction.
"Promotion Period" shall mean period commencing from 5 th January 2010 00:00:00 IST up to 28th February 2010 23:59:59 IST unless cancelled / terminated earlier in accordance with this Promotion terms and conditions and eBay UAs.
Users and/ or transactions which are not eligible for cash back or any other benefit or claims under this Promotion are as follows:
This Promotion is valid only for those Users who remain registered users and are neither suspended nor in violation of eBay UAs and PaisaPay services and this is without reference to or liability to SBICPSL in any manner whatsoever at any time pre or post this transaction on the Website. This Promotion is not valid for those persons resident outside India and/ or minors and/ or person inco mpetent to contract and any acceptance of offer and usage of Promotion Code by these Users shall be invalid and void ab initio.
This Promotion is not valid and shall not be used by such Users who under any statutory obligations are prohibited to use such Promotions or Promotion Codes.
Promotion Code cannot be used to buy the items which are required to be shipped outside India .
This Promotion shall not be valid for those transactions where payment has not been made through SBICPSL credit card.
User will not receive or claim cash back if User enters wrong Promotion Code on the Website.
This Promotion shall not be valid if the transaction has been disputed at any stage including post payment for the transaction. In case User already made the payment for the transaction which has been disputed and User not received the item, the amount paid by the User shall be refunded to the User as per Website PaisaPay terms and conditions.
This Promotion shall not be valid in case of rejection of payment by eBay due to eBay's risk containment measures.
Promotion Code can't be used to buy any item which is illegal or prohibited by eBay UAs.
One Promotion Code can't used for more than one transaction irrespective of the value of such transaction.
Promotion shall not be valid on cancelled or deleted listings.
Promotion Code is property of the Website. The offer under this Promotion has been given gratuitously to Customer for use on the Website. This Promotion and the offer contain therein is a privilege from eBay and not a right or claim against eBay.
Promotion Code carries no cash value and cannot be transferred, negotiated, sold and redeemed against cash.
The value and the mode of using of the Promotion Code shall be mentioned in the communication sent to the Customers.
Decision of eBay in consultation with SBICPSL on all aspects with regard to administering the Promotion, shall be final and binding on all Customers.
SBICPSL is neither responsible for nor guarantees the quality or delivery of the goods and shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods availed of by the Customers under the Promotion. Users can contact eBay Customer Support channels through Contact Us and User concern will be handled as per eBay UAs.
SBICPSL holds out no warranty or makes no representation about the quality, merchantability, delivery or otherwise of the goods purchased on the Website.
All communication / notices with regard to this Promotion should be addressed as per eBay UAs and by using eBay Customer Support channels through Contact Us as mentioned on the Website without any reference to SBICPSL .
eBay does not warrant that the Website will run concurrently and error free during the Promotion Period and does not commit any uptime of Website. Further eBay shall not be liable for technical error.

eBay or its suppliers, affiliates and service providers makes no representation or warranties of any kind regarding any product or service provided by any third party in connection with any Promotion Code and shall not be responsible for any costs, damages, accident, delay, injury, loss, expense or inconvenience that may arise in connection with the use of Promotion Codes.
Limitation of Liability: In no event shall eBay or its suppliers, affiliates and service providers are liable under this promotion either for tortuous or special or any other liabilities which may arises. eBay's liability under no circumstances shall exceed giving the User a replacement Promotion Code of the same nature and of the same value. eBay's suppliers, affiliates and service providers liability under no circumstances shall exceed the value associated with the Promotion Code received or used by the User.
User using the Promotion Code in any manner shall be deemed to have read, understood and accepted these terms and conditions.
These terms and conditions are subject to Indian laws and any dispute shall be subject to jurisdiction of the courts in New Delhi (India) only.
