Terms and Conditions

Eligibility:

• The promotion "eBay's Diwali Promotion" is valid for any successful PaisaPay purchase, in any category during promotion period.
• The promotion period shall be from 16th September 2009 till 17th October 2009.
• The offer is valid only for registered buyers of www.eBay.in (herein after "the Website") with Registered Addresses in India only.
• Free Gift Promotion: Any buyer who, during the promotion period, in a single transaction including the amount paid for shipping, using the respective Promotion codes spends:
  1. Between Rs. 1,000/- to Rs. 4,999/- Shall be eligible to choose a single Gift from the options available and specified in the promotion. (Hereinafter referred to as Category A); or,
  2. Between Rs. 5,000/- to Rs. 9,999/- Shall be eligible to choose a single Gift from the options available and specified in the promotion. (Hereinafter referred to as Category B); or,
  3. For Rs 10,000/- & above shall be eligible to choose a single Gift from the options available and specified in the promotion. (Hereinafter referred to as Category C).
• Weekly Bumper Prize Promotion: Any buyer who, during the promotion period, wants to participate for the Weekly Bumper Prize, shall be eligible ONLY if the buyer qualifies the below criteria:
  1. The buyer should have participated in 'eBay Diwali Promotion' i.e. bought a product above Rs. 1,000 and redeemed one of the gift options, using the unique coupon code during checkout
  2. The buyer should have correctly answered both the questions mentioned on the promotion landing page and entered his/ her User ID & the PaisaPay ID of the eligible transaction on the promotion landing page.

• The highest amount actually paid in the single transaction (including shipping costs) against which Gift is claimed, shall be considered as the amount of transaction.
  
• Only one gift can be claimed, per transaction, against each Category (A, B or C).
  
• Weekly Bumper Prize Promotion, winners will be selected from the list of eligible users for the Weekly Bumper Prize. eBay reserves right to decide on the number of Bumper Prize(s), item and value. The selection for winner(s) shall be done by an independent agency and the decision of independent agency shall be binding on both the user and eBay.
• eBay will contact the winner(s) of the Weekly Bumper Prize and its mandatory for the winner(s)to provide eBay a Tax Paid Certificate for the Bumper Prize. The Bumper Prize gift would be dispatched only after the selected winner produces a proof of payment of TDS on winnings (Bumper Prize gift value)
• Please Note: The gifts will be sent to the REGISTERED ADDRESS ONLY and not the SHIPPING ADDRESS. Users are requested to update their REGISTRATION ADDRESS to ensure that they receive their gifts.
• If within a 2 week from the date of transaction, your Website user ID or PaisaPay access gets suspended from the Website you will not be eligible to receive the gift.
• eBay will make every attempt to dispatch the gift promised, however in case of a stock out situation in the market, eBay will provide a similar gift of the same or higher value.
• The gift will be dispatched at the latest 45 days from the date of the eligible transaction.

General Terms and Conditions

1. You should not be in violation and agree to abide with the terms and conditions of the User Agreement, policies of the Website (including this promotion).
2. eBay reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the terms & conditions of this Promotion, or to replace, wholly or in part, this Promotion by another Promotion, whether similar to this Promotion or not, or to withdraw it altogether, and eBay's decision in this regard shall be final.
3. All decisions of eBay regarding running / process / results, of the promotion, data selection shall be final and binding on all participants of this promotion, including you. No appeals will be entertained in this regard.
4. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, substitute, change or cancel the Promotion, eBay reserves the right to suspend, change, substitute or cancel the Promotion at any time.
5. If eBay has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity related to this promotion, eBay reserves the right to disqualify that entrant and any related entrants. Any entrant user of the Website who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant user and its related user id's on the Website.
6. eBay does not warrant that the Website will run concurrently and error free during or after the Promotion Period and does not commit any uptime of the Website. Further eBay shall not be liable for issues related to technical, human error whatsoever e.g. wrong Promotion number being entered by you or you being logged out of system.
7. eBay does not accept, and is not responsible for, any lost or delayed data, communication. eBay reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay that may affect entry/participation to the Promotion.
8. The items are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land.
9. eBay is neither responsible nor guarantees the make, quality of the product, items, which is purely responsibility, liability of third party. Nor is eBay liable for any defect, deficiency, shortcoming or any risk associated with the quality, commitment, deliver timeline of the products, items.
10. The administrator of this Promotion would undertake reasonable efforts to complete the process of declaration of results, verify and deliver the item at the earliest, by 45 days. However, is subject to no delays being caused by third party vendors or Force Majeure. eBay however shall not assume the risk of insurance and other related security, features, liability during transit.
11. The gifts will be sent to the REGISTERED ADDRESS ONLY and not the SHIPPING ADDRESS. Users are requested to update their REGISTRATION ADDRESS to ensure that they receive their gifts.
12. For certain states within India, FORM 50/ FORM 31 are required by the courier company for the dispatch of the free gifts. When required, the registered buyer is responsible for providing the courier company with the above mentioned FORM/s to receive the free gift.
13. You understand and agree that participation in the Promotion is good and sufficient consideration for you to agree and be bound by these Terms and Conditions.
14. Any and all taxes, including without any limitation income tax (if any) applicable on this Promotion and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
15. All Coupons should be redeemed within its validity period.
16. All communications with you will be, on your email (ID registered on Website) and / or community board.
17. The benefits under the Promotion CANNOT be clubbed with other offers running on the Website, including vouchers or any other offer available on the Website.
18. The employees and the immediate family members of the employees of eBay and its associate companies are NOT eligible to participate in the Promotion
